App bookings, buses and autos: who pays the GST

When a ride is booked through an app, the app pays the GST, not the driver or operator. That started with taxis and bikes in July 2017 and covers almost every vehicle since 1 January 2022. Buses and autos booked offline are mostly exempt; AC buses pay 5%.

Current is what applies today. Upcoming is notified and starts later. Expired shows what applied before, from which date to which date, for when an old invoice or a notice asks.

App-booked bus rides: company bus operators pay their own GSTThe app operator pays the GST on rides by any vehicle except buses, and on bus rides only where the bus operator is not a company. A bus company charges and pays the GST itself. Our reading: Whether a subscription-only app that does not set or collect the fare must pay GST on the rides is not settled. Who can claim GST credit

Input tax credit (ITC) is GST you paid on a purchase that you subtract from the GST you collect. Whether you get it depends on who you are and what you bought.

What courts and rulings have said

Judgments and advance rulings that explain a rule, including ones that pull in different directions. Weigh them by who gave them: a Supreme Court judgment binds every court in India; a High Court’s is followed by courts and tax officers in its State and is persuasive elsewhere; an advance ruling (AAR or AAAR) binds only the business that asked for it and its tax officer (section 103 of the CGST Act).

The code you print on the invoice: SAC for a service, HSN for goods. Since 1 April 2021 an invoice must show at least 4 digits if last year’s turnover was up to ₹5 crore, and 6 digits above that. Descriptions follow the government’s classification of services.

When the app pays the GST

Section 9(5) of the CGST Act makes the app (the e-commerce operator) pay the GST on certain services sold through it, as if it had supplied them. For rides:

  • From 1 Jul 2017: radio taxis, motorcabs, maxicabs and motorcycles.
  • From 1 Jan 2022: any motor vehicle, including buses and autos. App-booked autos and non-AC buses stopped being exempt.
  • From 20 Oct 2023: for buses, only where the bus operator is not a company. A bus company charges and pays its own GST.
Worked exampleAn operator's month, split by channel

You run ten cars. This month ₹4,00,000 of duties came from your own company customers and ₹1,50,000 of rides came through a ride-booking app. You are on the 5% option.

Own customersThrough the app
Value of trips₹4,00,000₹1,50,000
GST on your own invoices (5%)₹20,000₹0
GST paid by the app₹0Paid by the app

Whether a subscription-only app, which charges drivers a fee and does not set or collect the fare, counts as the operator here is being argued in court. There is no circular on it yet.

Buses, autos and school runs

  • AC buses, stage or contract carriage, pay 5% with no input credit.
  • Non-AC route buses are exempt, and so are non-AC contract carriages except for tourism, conducted tours, charter or hire.
  • Autos, e-rickshaws and metered cabs are exempt when hailed or booked offline.
  • A bus rented with driver and fuel also fits the renting entry used for cab hire, with its 5% or 18% options. Our reading: the notification does not say whether that entry or the AC-bus entry above wins, so take advice before charging 18% for an AC bus.
  • School transport billed to the school (pre-school to higher secondary) is exempt, and so is hiring a vehicle to the contractor who runs it.
Worked exampleA staff bus for a factory

You rent a 32-seat AC bus with driver and fuel to a manufacturer for its shift transport at ₹1,80,000 a month.

18% renting option (our reading)5%, AC bus entry
Monthly rent₹1,80,000₹1,80,000
GST₹32,400₹9,000
Credit the manufacturer can usually take₹32,400₹9,000
Net cost to the manufacturer₹1,80,000₹1,80,000

The block on credit for hiring vehicles covers only vehicles of up to 13 seats, so a business hiring a bigger bus for its own work can usually take the GST back either way. The difference is yours: at 18% you can claim credit on the bus, its servicing and other inputs; at 5% you cannot. Whether the 18% option is open for an AC bus is our reading, so ask your CA before using it.

Common questions

Do I charge GST on trips I get from a ride app?

Where the app is the e-commerce operator under section 9(5), no: the app pays the GST on those rides. Keep them out of your own taxable invoices and check how the app's statement shows them.

Are non-AC buses always exempt?

Non-AC route buses are exempt, and so are non-AC contract carriages except for tourism, conducted tours, charter or hire. A non-AC bus hired out for a tour or charter is taxable.

Do autos booked through an app pay GST?

Yes, from 1 January 2022, and the app pays it. Autos hailed on the street or booked offline remain exempt.

Is transport for a college exempt like school transport?

No. The exemption covers only schools, from pre-school to higher secondary, and only when the bill is to the school.

Let the bill carry the right GST and TDS

Travel Softdrive raises GST invoices and e-invoices from your duties, and deducts and tracks TDS on supplier bills, so month-end is a check, not a rebuild.
